PRIVACY POLICY
This Privacy Policy has been prepared to affirm Cancable Inc.'s strong commitment
to maintaining the privacy of its customers, suppliers and others and to inform
these individuals of its practices concerning the collection, use and disclosure
of personal information provided to Cancable Inc. about any identifiable person.
Cancable Inc. respects its customers' privacy and is committed to protecting it.
The purpose of this Privacy Policy is to establish, in accordance with applicable
legislation, rules to govern the collection, use and disclosure of personal information.
This Privacy Policy describes our policies and practices regarding the use of our
customers' personal information, how we safeguard it, and how to contact us to access
your personal information. Cancable Inc. deals with the collection, use and disclosure
of personal information of our employees under a separate policy.
1. Accountability
Cancable Inc. recognizes its responsibility to maintain the confidentiality of personal
information under its control and has designated Tracy Lee as Privacy Officer to
oversee the collection, use and disclosure of personal information within its business
and to ensure compliance with all applicable privacy legislation.
2. Identifying purposes
Cancable will disclose to its customers the purpose for which personal information
is collected before or during the time of collection.
In general, personal information is collected from our customers to establish credit,
send out invoices, provide marketing information, identify and address needs and
demands of customers, and to provide notice of promotional and advertising campaigns
and other products and services that may be of interest to customers and to respond
to specific inquiries from customers.
If personal information is collected for purposes other than those identified above,
Cancable Inc. will identify the new purpose before the information is used. Unless
the new purpose is required by law, the consent of the individual will be obtained
prior to use of the information.
3. Consent
Consent will be requested at the time of collection where possible. We will make
reasonable efforts to ensure that the Customer is advised of the purposes for which
the information will be used. However, consent will not be required where inappropriate
in the circumstances including, without limitation, in the case of compromise to
the availability or accuracy of the information being collected, used and disclosed
as part of an investigation into the breach of an agreement or a contravention of
law, an emergency that threatens the life, health or security of a person, or as
required by law.
Consent may be express or implied. In some cases, we may ask you to provide express
consent for specific purposes. If so, we will ask you to confirm this express consent
orally or in writing, as applicable. In other cases, your consent will be implied
if we ask you to provide personal information for a stated purpose. Customers may
be asked to provide their implied or express consent to our collection and use of
contact information or financial information required to provide a Service. Customers
may choose not to provide us with such information. However, if this choice is made,
we may not be able to provide the product or Service requested (for example: delivery
of a product or Service may require an address, or payment may require provision
of credit card information).
We shall not, as a condition of supply of our product or Services, require a customer
to consent to the collection, use, or disclosure of information beyond that required
to fulfill specified and legitimate purposes.
New customers are required to complete credit application forms. A customer can
withdraw consent at any time, subject to legal and contractual restrictions and
reasonable notice. We will notify the customer of the implications of such withdrawal.
4. Limiting collection
The collection of personal information shall be limited to that which is necessary
for the purposes identified above. Information shall be collected by fair and lawful
means.
5. Limiting use, disclosure, and retention
Personal information shall not be used or disclosed for purposes other than those
for which it was collected, except with the consent of the Customer or as required
pursuant to a court order or otherwise by law.
Personal information shall be retained only as long as necessary for the fulfillment
of those purposes. It is our policy to retain the information for 5 years. Personal
information that is no longer required will be destroyed, erased, or made anonymous.
Hard copies of the information will be shredded and electronic versions will be
erased. Any individual may request that we remove his or her personal information
from our records at an earlier time. Subject to our requirements for continued retention
of such information (for example, for billing, audit or warranty records or other
legal purposes), we will make every reasonable effort to honour such request.
6. Accuracy
We will use reasonable efforts to ensure the accuracy and completeness of the personal
information we collect and use. If we hold any personal information about an individual
who can establish that it is not accurate, complete and up to date, we will take
reasonable steps to correct it.
7. Safeguards
Personal information shall be protected by security safeguards appropriate to the
sensitivity of the information. These safeguards shall protect personal information
against loss or theft, as well as authorized access, disclosure, copying, use, or
modification. Hard copies of customer information will be kept in a locked filing
cabinet and electronic access to the information will be restricted by password
protection with access only being given to authorized personnel.
8. Openness
We will make readily available to customers, information about our policies and
practices relating to the management of personal information.

9. Individual access
Upon written request, an individual shall be informed of the existence, use, and
disclosure of his or her personal information and shall be given access to that
information at reasonable times and at a convenient place designated by Cancable
Inc. However, in certain situations, Cancable Inc. may not be able to provide access
to all the personal information it holds about an individual including, without
limitation:
1. information that is prohibitively costly to provide;
2. information that contains references to other individuals;
3. information that cannot be disclosed for legal, security, or commercial proprietary
reasons;
4. the information is subject to solicitor-client or litigation privilege, or such
information relates to existing or anticipated legal proceedings against an individual
to whom the information relates; or
5. if the request for access is frivolous or vexatious.
If we deny your request for access to, or refuse a request to correct information,
we will explain the reason for our refusal.
Cancable Inc. will respond to an individual's request for access to his or her personal
information within a reasonable time period of not later than 30 days, unless extended
in accordance with applicable law and will be at minimal or no cost to the individual.
10. Challenging compliance
An individual may address a challenge concerning compliance with the above principles
to Cancable Inc.'s Privacy Officer. We will investigate all complaints received.
If a complaint is justified, appropriate measures will be taken, including, if necessary,
amending our policies and practices.
In addition to other lawful remedies available to an individual, an individual may
bring an action in a court of competent jurisdiction against Cancable Inc. for a
breach by Cancable Inc. of the principles and policies contained herein.
